Terms of Service

1. What Foveal is
Foveal is web-based practice-management and electronic medical record software for eye clinics, provided as a subscription by Foveal ("we", "us"), Pune, India. It is a record-keeping tool: it does not provide medical advice and does not replace clinical judgment. Responsibility for clinical decisions and for the accuracy of records rests with the clinic and its practitioners.
2. Subscription and payment
- Pricing is per clinic, per year, as published on the pricing page at the time of purchase. Founding-clinic pricing, where offered, is locked for the stated period.
- Payment is by UPI or bank transfer against an order note. Your subscription activates when payment is confirmed and runs for 12 months.
- Renewal is by fresh payment; we remind you before expiry. If a subscription lapses, the clinic moves to read-only access — your data is never deleted for non-renewal.
3. 30-day money-back guarantee
Within 30 days of activation you may cancel for any reason and receive a full refund, normally within 7 days, to the account that paid. On request we provide a complete CSV export of your clinic's data before closure.
4. Your data
- Your clinic's records belong to your clinic. We process them only to provide the service (see the Privacy Policy).
- The clinic owner can export all clinic data as CSV at any time.
- On termination, we provide export on request and delete clinic data after a grace period of 90 days, except where law requires longer retention.
5. Your responsibilities
- Each staff member uses their own account; the clinic is responsible for keeping credentials and clinic devices secure and for deactivating staff who leave.
- The clinic is responsible for obtaining patient consent it is required to obtain, and for the lawfulness of the records it creates.
- No reselling, no attempting to breach isolation between clinics, no reverse engineering.
6. Service and support
We aim for continuous availability but do not promise a specific uptime percentage. Support is provided over WhatsApp and email during Indian business hours, with best-effort response outside them. We may perform maintenance with reasonable notice.
7. Liability
To the maximum extent permitted by law, our total liability in any 12-month period is limited to the subscription fees paid for that period. We are not liable for indirect losses, or for losses caused by internet outages, device failure, or use contrary to these terms.
8. Changes and governing law
We may update these terms with notice; continued use after notice is acceptance. These terms are governed by the laws of India; courts at Pune have jurisdiction.
